Federal Excise Tax (FET): All firearms sold are subject to Federal Excise Tax under 26 U.S.C. § 4181 at the rate of 10% for pistols and revolvers, or 11% for other firearms and ammunition. FET is included in the manufacturer's sale price and has been paid by Kings River Custom as the manufacturer. This tax is imposed at the manufacturer level and is incorporated into the retail pricing.

Consumer Protection:
Sales are subject to Arkansas consumer protection statutes and Federal Trade Commission regulations.

Dispute Resolution:
Disputes shall be resolved under Arkansas law through negotiation, mediation, or litigation in Arkansas courts as appropriate.

Federal Compliance:
All sales comply with Federal Firearms License (FFL) requirements and Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) regulations.

4. ORDER PLACEMENT AND ACCEPTANCE


  1. The Buyer places an order through the Seller's website, mobile application, telephone, email, or other designated channels.
  2. When placing an order, the Buyer must provide accurate and complete information including: full name, delivery address, contact telephone number, email address, and any other information required for proper order fulfillment.
  3. After placing an order, the Buyer receives an order confirmation via email or SMS containing order details, total amount, and estimated delivery time.
  4. The Seller reserves the right to refuse or cancel any order at its sole discretion, including cases of: incorrect pricing due to technical errors, unavailability of goods, suspected fraudulent activity, or inability to verify the Buyer's information.

5. PAYMENT TERMS


  1. Payment for goods/services must be made in full at the time of order placement unless otherwise agreed. (Non-Refundable deposits of 25% of purchase total are required before work starts.)
  2. The Seller accepts the following payment methods: Visa, MasterCard, American Express, bank transfer.
  3. All online payments are processed through secure payment gateways. The Seller does not store complete credit card information.
  4. The Buyer is responsible for any bank fees, currency conversion fees, or transaction charges imposed by their financial institution.
  5. An order is considered confirmed only after successful payment verification by the Seller.

6. DELIVERY TERMS


  1. Delivery is available to the following regions: United States lower 48.
  2. Estimated delivery times are: Dependent on each individual custom build and can vary considerably.
  3. Delivery costs are calculated based on the delivery address, package weight, and chosen delivery method. Delivery fees are displayed at checkout before payment.
  4. The Seller partners with reliable courier services including: FedEx, UPS, local postal service.
  5. Risk of loss or damage to goods passes to the Buyer upon delivery. The Buyer must inspect goods upon receipt and report any visible damage to the courier and Seller immediately.
  6. If the Buyer is not available at the delivery address, the courier will attempt delivery according to their standard procedures. Unclaimed packages may be returned to the Seller, and redelivery charges may apply.

7. RETURNS AND REFUNDS


  1. The Buyer has the right to return goods within 14 (fourteen) days from the date of receipt, provided the goods are unused, in original packaging, and in resalable condition.
  2. To initiate a return, the Buyer must contact the Seller at info@kingsrivercustom.com OR 479-665-2277 and provide order number, reason for return, and photographic evidence if applicable.
  3. The following items are not eligible for return: Firearms or parts damaged by the end user.
  4. Return shipping costs are the responsibility of the Buyer unless the return is due to Seller error or defective goods.
  5. Refunds will be processed within 7-14 (seven-four) business days after the Seller receives and inspects the returned goods. Refunds will be issued to the original payment method.
  6. If goods are damaged during return shipping due to inadequate packaging by the Buyer, the Seller reserves the right to deduct repair costs or refuse the return.

8. WARRANTY


  1. All goods sold by the Seller come with a manufacturer's warranty unless otherwise stated. Warranty terms and duration vary by product and manufacturer.
  2. The Seller warrants that at the time of delivery, goods are free from defects in materials and workmanship and conform to the description provided.
  3. Warranty does not cover damage resulting from: misuse, negligence, accidents, unauthorized repairs, normal wear and tear, or failure to follow manufacturer's instructions.
  4. To make a warranty claim, the Buyer must contact the Seller within the warranty period and provide proof of purchase, description of the defect, and photographic or video evidence if requested.
  5. The Seller will, at its discretion, repair, replace, or refund defective goods covered under warranty.
  6. KRC has its own warranty policy shipped with every firearm.

9. LIMITATION OF LIABILITY


  1. The Seller's total liability for any claims arising from or related to this Public Offer shall not exceed the amount paid by the Buyer for the specific goods or services giving rise to the claim.
  2. The Seller is not liable for indirect, incidental, special, consequential, or punitive damages including but not limited to: loss of profits, loss of data, business interruption, or loss of business opportunity.
  3. The Seller is not responsible for delays or failures in performance resulting from circumstances beyond its reasonable control, including: natural disasters, strikes, wars, government actions, telecommunications failures, or supplier delays.
  4. The Seller makes no warranties regarding uninterrupted or error-free operation of its website or mobile applications.

10. PERSONAL DATA AND PRIVACY

Unauthorized use, reproduction, or distribution of any content from the Seller's website is strictly prohibited and may result in legal action.

12. DISPUTE RESOLUTION


  1. The parties agree to make good faith efforts to resolve any disputes arising from this Public Offer through negotiation and mutual agreement.
  2. If a dispute cannot be resolved through negotiation, it shall be referred to mediation before proceeding to litigation.
  3. This agreement is governed by the laws of the State of Arkansas and applicable United States federal law.
  4. Any legal proceedings arising from this Public Offer shall be brought exclusively in the courts of HUNTSVILLE, AR 72740/MADISON COUNTY.
